Ben is an experienced, committed, and responsive commercial litigator, who is dedicated to understanding and achieving his clients’ unique set of goals, whether that means finding the best possible resolution before litigation is filed or zealously advocating for his clients’ rights and interests in state and federal courts and private arbitration throughout the country. •  Represented residuals management company and its owners in defense of claims by competitor based on unfair competition, tortious interference, and aiding and abetting breach of fiduciary duty and violation of Wisconsin statutes, and successfully secured dismissal of all claims on summary judgment. New Earth USA, LLC v. Neoteric Solutions, LLC et al.

 

•  Represented employee-physician against major healthcare provider in obtaining injunctive relief to bar enforcement of post-employment restrictive covenant provisions, leading to favorable settlement of all claims.

 

•  Represented major independent insurance agency in enforcing restrictive covenant provisions against former employee and his new employer, and secured injunction and numerous other successes during the litigation, leading to favorable settlement of all claims. •  Represented lessee in complex dispute over 50-year lease of downtown parcel and related development, which resolved on favorable terms in settlement. Northwestern Mutual v. ABFH LLC

 

•  Represented former director in complex, multi-million dollar shareholder dispute, and secured dismissal of all claims against client on motion to dismiss as well as an order requiring the company to pay his legal fees and costs. Nathan Brand et al. v. William Linton et al.

 

•  Represented defendant in breach of contract, private nuisance, and injunction action, and successfully obtained voluntary dismissal of all claims without consideration or other payment. 833 Buena Vista Tierra Investors, LLC, et al. v. JSWD Wisconsin Venture 1, LLC, et al.

 

•  Represented commercial developer in action against insurer and insurance agent following substantial water damage loss at downtown property and obtained favorable settlement shortly before trial. Midwest Commercial Funding LLC v. Cincinnati Insurance

 

•  Represented major healthcare organization in defense of claim for breach of contract filed by national commercial real estate brokerage, advisory, and consulting firm concerning dozens of leased properties and millions in fees, and successfully defended the action and resolved all claims for a highly favorable settlement.

 

•  Represented employee in action filed by former employer based on breach of contract, theft of trade secrets, and breach of fiduciary duty, and successfully negotiated settlement of all claims. SmithGroupJJR, Inc. v. Capstone Engineering Design, LLC

 

•  Represented debtors and personal guarantors in federal action against national bank, and successfully negotiated settlement of all claims. Berlin, et al. v. Bank of America, et al.

 

•  Represented multiple defendants / counterclaim-plaintiffs / third-party plaintiffs in complex contract and tort action following a failed development in municipal TIF district, and successfully negotiated settlement of all claims. City of Ripon v. Ripon Renew, Inc. et al. v. Will, et al.

 

•  Represented defendant-employees accused of breach of contract and violation of restrictive covenant provisions and obtained successful settlement and dismissal of all claims following multi-day mediation before federal magistrate. Priority IAC Inc. v. Bryk, et al.

 

•  Represented plaintiffs in FINRA securities arbitration asserting claims for “selling away” and negligent supervision, and obtained favorable settlement on behalf of clients shortly before final hearing.

 

•  Represented defendants in an action for breach of contract and equitable indemnification and secured dismissal of all claims on motion to dismiss. Moon v. Belinda Moon, LLC, et al.

 

•  Represented defendant-members of LLC accused of fraud and breach of contract and secured dismissal of all claims on motion to dismiss. Next Electric v. Washhouse Partners, LLC

 

•  Represented defendant-employer in action filed by former employee for unlawful employment practices under federal and state law, and assisted in securing dismissal of all claims on motion to dismiss. Bach v. Centocor Ortho Biotech, Inc., et al.

 

•  Secured important revisions to special assessment report and resolutions related to a municipal project and negotiated sale of real property with municipality in related eminent domain action.

 

•  Represented major commercial developer in failed multi-million dollar downtown project and successfully obtained favorable settlement of all claims at mediation.

 

•  Successfully represented numerous debtors and personal guarantors in complex creditor-debtor actions concerning millions and tens of millions of dollars of debt, and obtained settlements of all claims, including reduced payoff amounts and/or loan extensions.

 

•  Successfully represented numerous minority members and shareholders in breach of contract, breach of fiduciary duty, and minority member/shareholder oppression matters and obtained favorable settlements after pursuit of claims, declaratory judgment, and injunctive relief.

 

•  Successfully negotiated separation and severance agreements on behalf of both employers and employees, including executives, in-house lawyers, physicians, securities brokers, and many others.

ABOUT BEN

Ben was born and raised in Wisconsin and currently lives in Shorewood with his wife, Lauren, sons, Jack (3 yo.) and William (6 mo.), and dog, Nellie. Ben is a lifelong Badger fan and steadfast supporter of the Packers/Brewers/Bucks. In addition to spending time with family, Ben loves to travel, spend time on the water, watch live music whenever possible, and work on his golf game.
